Privacy Policy

Last updated: June 26, 2025

Thank you for visiting The Markets in Vitro. We are committed to protecting your personal data and respecting your privacy in accordance with the General Data Protection Regulation (GDPR) of the European Union and applicable U.S. laws such as the California Consumer Privacy Act (CCPA).

1. Data Controller
The data controller for this website is:
Dr. Frederik Klauser
Gumpendorfer Str 142
1060 Vienna
Austria

E-mail: SP500.navigator@gmail.com

2. What personal data we collect

  • Contact information (e.g., name, email address)
  • Technical data such as IP address, browser type, and device information
  • Usage data such as page views and navigation behavior (via cookies or analytics)

3. Purpose of data processing

  • To respond to your inquiries
  • To improve and analyze the performance of our website
  • To deliver services such as trading signal subscriptions (if applicable)
  • To comply with legal obligations

4. Legal basis for processing

  • Your consent (Art. 6(1)(a) GDPR)
  • Performance of a contract (Art. 6(1)(b) GDPR)
  • Compliance with legal obligations (Art. 6(1)(c) GDPR)
  • Our legitimate interests (Art. 6(1)(f) GDPR)

5. Cookies and similar technologies
Nothing outside the “strictly necessary” category is stored on or read from your device before you allow it. We ask on your first visit and store your answer for twelve months. You can change or withdraw it at any time via Privacy choices in the footer of every page, and withdrawing is exactly as easy as consenting.

We group storage into four categories:
Strictly necessary — your theme choice, your sign-in session, and the record of the choices you make here. Used without consent, as permitted by section 25(2) TDDDG and Article 5(3) of the ePrivacy Directive.
Preferences — how you have set the site up: chart timeframes, visible panes, table modes, board filters. Without this consent these settings last only until you leave the page.
Statistics — Google Analytics, our own page-view counter, and the live TradingView charts.
Marketing — Google Ads conversion measurement for our own campaigns, the campaign you arrived from, and Trustpilot's official “Review us” button on the home and pricing pages. We do not sell advertising space and no third-party ad network runs on this site.
The Cookie Policy lists every entry by name, provider, purpose and retention.

Proof of consent. Article 7(1) GDPR requires us to be able to demonstrate that you consented. When you make or change a choice we therefore record, on our own server: a random reference that is generated in your browser and stored only in your miv_prefs cookie, the time, the categories you allowed, the version of this policy you were shown, a shortened IP address (the last block is discarded) and your browser identification. We keep these records for three years and delete them afterwards. We never read this record to decide anything while you browse — it exists solely as evidence. Your reference is displayed to you in the settings dialog; quote it if you want us to look up or delete your record.

Clearing your cookies withdraws your consent. We deliberately keep no second copy anywhere that could restore it.

6. Third-party services
With your consent we use Google Analytics (statistics), the Google Ads conversion tag for our own campaigns (marketing), Trustpilot A/S, Denmark, for the review button on the home and pricing pages (marketing; without consent a plain link is shown and nothing is loaded from Trustpilot), and TradingView for the live interactive charts (statistics). Memberstack handles sign-in and Stripe handles payment; both are strictly necessary to deliver the service you asked for. These providers process data under their own privacy policies. We removed Google AdSense from this site in September 2026 and no longer display third-party advertising.

7. International Data Transfers
Some of the services above process your data in the United States, and we name them rather than leave it general.

Google LLC (Analytics, Ads) is certified under the EU–US Data Privacy Framework. The European Commission's adequacy decision of 10 July 2023 covers that transfer, so no additional safeguard is required.

TradingView is not covered by that framework. If you allow the “Statistics” category, the live charts load from TradingView and your IP address and browser data reach a US company that is not subject to an adequacy decision. That transfer rests on your explicit consent under Article 49(1)(a) GDPR. US authorities may be able to access such data, and you may have no equivalent legal remedy there. Declining “Statistics” means the live charts do not load; every other chart on this site is served from our own servers and needs no consent.

Where a provider is neither covered by an adequacy decision nor by your explicit consent, we rely on the Standard Contractual Clauses approved by the European Commission.

8. Data Processing Agreements
We have concluded data processing agreements with our service providers to ensure the security and lawful processing of your personal data.

9. Data Retention
We retain data only for as long as necessary for the purposes for which it was collected or as required by law.

10. Your Rights Under the GDPR

  • The right to access your data
  • The right to rectify or delete your data
  • The right to restrict or object to processing
  • The right to withdraw consent at any time
  • The right to lodge a complaint with a supervisory authority

You can exercise these rights by contacting us at SP500.navigator@gmail.com. We will respond within one month.

11. Right to Lodge a Complaint
You also have the right to lodge a complaint with the Austrian Data Protection Authority:
Österreichische Datenschutzbehörde
Barichgasse 40-42
1030 Vienna, Austria
Email: dsb@dsb.gv.at

12. Children's Privacy
Our site is not intended for children under 16. We do not knowingly collect data from children without parental consent.

13. Automated Decision-Making and Profiling
We do not use personal data for automated decision-making or profiling that produces legal effects. If this changes, you will be informed and provided opt-out options.

14. Advertising
We do not display advertising on this site and no advertising network is embedded in it. Google AdSense was removed in September 2026. What remains under the “Marketing” category is the opposite direction: a Google Ads conversion tag that tells us whether one of our own advertisements led someone to sign up. It runs only with your consent, and you can withdraw it at any time via Privacy choices in the footer.

15. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • The right to know which personal information we collect, use, disclose, or sell.
  • The right to request deletion of your personal information.
  • The right to opt out of the sale or sharing of personal information.
  • The right to non-discrimination for exercising your privacy rights.

You can exercise your rights by contacting us at SP500.navigator@gmail.com.

16. Security Measures
We use encryption, access control, and monitoring to protect personal data against unauthorized access, loss, or misuse.

17. Data Breach Notification
In the event of a data breach, we will notify affected users and the authorities as required by GDPR Articles 33 and 34.

18. Policy Updates
We may update this policy. Changes will be posted here with an updated revision date.

19. Contact
If you have any questions or concerns regarding this Privacy Policy or wish to exercise your data protection rights, please contact us at SP500.navigator@gmail.com.
